Hello. I am Attorney Kim Yae-jin.
KIM&ASSOCIATES provides legal services in English, and as a result, we have recently seen a gradual increase in clients who are U.S. citizens and U.S. companies.
In this case, the headquarters of a U.S. company dispatched a branch manager to a foreign-invested enterprise it had established in Korea. KIM&ASSOCIATES filed applications with the immigration authorities for the issuance of a D-8 (Corporate Investment) visa for the branch manager—who was dispatched as a manager to the Korean foreign-invested enterprise—and an F-3 (Dependent) visa for the branch manager’s family.
The visa issuance process is broadly divided into two methods. The first involves the visa applicant directly applying for a visa at a diplomatic mission (a Korean embassy or consulate located abroad). The second involves the inviting party submitting an application for “approval” of visa issuance to the immigration office to obtain a visa approval number, after which the visa applicant uses that number to apply for a visa at a diplomatic mission. Which method is available varies depending on the specific visa type; however, for branch managers dispatched to foreign-invested companies, the inviting company—the foreign-invested enterprise—must first apply to the immigration office for visa issuance approval in its capacity as the sponsor.
We coordinated with the U.S. company’s headquarters, the foreign-invested enterprise, and the branch manager scheduled for assignment to prepare the necessary documentation. We then submitted the application for visa issuance approval to the immigration office as described above and obtained the visa issuance approval number, enabling the branch manager and his family to apply for visas at the overseas diplomatic mission.
At KIM&ASSOCIATES, Attorney Kim Yae-jin personally handles the paperwork and applications required for visa issuance, and we put a lot of effort to provide the best possible legal services tailored to each client’s needs.
