Hello. I am Korean Attorney Kim Yae-jin.

Our lawfirm handles a wide range of registration matters for foreign nationals. For foreign nationals—especially those residing abroad—the process of registering with a Korean registry office requires more complex documentation than it does for Korean nationals or foreign nationals residing in Korea who are registered with the Korean government. In particular, for countries that do not use personal seals, such as the United States, Canada, and Australia, all signed documents must be notarized and apostilled before submission.

I would like to share a case from this year in which we successfully completed real estate inheritance registration despite the presence of foreign heirs residing abroad.

Mr. A, a Korean national, passed away late last year. He was survived by B, a child from a previous marriage who had lost Korean citizenship upon acquiring foreign nationality; his current spouse, C; and D, a child born to him and his current spouse. With the cooperation of B—the child from a previous marriage residing abroad—our office was able to prepare all the necessary documents for the inheritance registration and successfully complete the process. Child B, the child from a previous marriage who is a foreign national, signed a “Power of Attorney for Legal Acts Regarding the Division of Inheritance by Mutual Agreement,” designating current spouse C as the attorney-in-fact, and had it notarized and apostilled. Additionally, since B’s name when a Korean national was completely different from their current name as a foreign national, B had a “Certificate of Identity” notarized and apostilled. Since B, the child from a previous marriage, decided not to inherit the real estate owned by A, we drafted an “Agreement on the Division of Inherited Property” stipulating that B’s current spouse, C, and child, D, would inherit the property. After affixing the official seals, we submitted the document and paid the acquisition tax, which is mandatory for inheritance registration.

Our law firm directly drafted Power of Attorney for Legal Acts Regarding the Division of Inheritance

by Mutual Agreement, Agreement on the Division of Inherited Property, Certificate of Identity for the client, in both Korean and English.

The clients were facing difficulties with the inheritance registration because one of the heirs was a foreign national residing abroad. However, with the assistance of our law office, they were able to

properly prepare the documents required from the foreign national residing abroad and successfully complete the real estate inheritance registration.
