Successful Revocation of Non-Referral Decision for Refugee Recognition (Immigation & VISA lawyer)

I would like to share another case in which we recently successfully won a lawsuit to overturn a decision not to refer a refugee status determination case for review, thereby allowing a foreign national to enter South Korea.

After receiving a decision denying him entry, Foreign National A filed an application for refugee status with the Director of the Incheon Airport Immigration and Foreigners’ Affairs Office, citing religious persecution as the reason; however, the deciding authority issued a decision not to refer his case for refugee status review.

I filed a lawsuit on behalf of Mr. A to overturn the decision not to refer his case for refugee status determination. When a foreign national applies for refugee status at a port of entry, the case must be referred for refugee status determination unless there are grounds specified in the Refugee Act, such as the submission of false documents or seeking refugee status solely for economic reasons. However, the authority issued a decision not to refer Mr. A’s case for refugee status determination despite the absence of such grounds. I argued these points before the court and submitted numerous pieces of evidence (including country-specific information) to support my claims. The court accepted my arguments and issued a judgment overturning the decision not to refer Mr. A’s case for refugee status determination.

Since the authority did not appeal, the favorable judgment became final, and Mr. A entered the Republic of Korea.
