I am pleased to share a recent case where we successfully won a lawsuit to revoke a non-referral decision of refugee status application, enabling a foreign national to enter the country.

Foreign national Mr. A was denied entry at Incheon International Airport and subsequently applied for refugee status with the Incheon Airport Immigration Office. However, the authority issued a decision refusing to refer his case for refugee status application.

I represented Mr. A in a lawsuit to overturn this refusal to refer his case for refugee status application. When a foreign national applies for refugee status at a port of entry, the application must be referred for refugee status determination unless there are grounds specified in the Refugee Act, such as submission of false documents or seeking refugee status solely for economic reasons. However, the authority issued a non-referral decision for Mr. A's refugee status application despite the absence of such grounds. I presented these points to the court, which accepted my arguments and issued a ruling canceling the decision not to refer Mr. A's case for refugee status application.

The authority did not appeal, so this favorable ruling became final and conclusive, and Mr. A entered the Republic of Korea.
